Are you wondering what permits are needed to launch a biogas plant?
Don’t worry, you don’t have to search any further! The type of permit mainly depends on the size of your installation and the type of energy produced ⚡.
Before you jump into the brilliant idea of investing in a biogas plant, it’s worth familiarizing yourself with the basic legal requirements related to such installations. Below, we present key information in a simplified form – think of it as your guide through the biogas jungle! 🌴
Type of Installation | Description of Installation | Required Permit |
Non-Agricultural Biogas Plants | Biogas plant producing electricity or electricity along with heat energy through cogeneration. | Micro Installation of RES - Biogas plant with a total installed capacity of up to 50 kW, connected to the power grid with a voltage below 110 kV. |
Larger Capacity Biogas Plant | Biogas plant with a capacity greater than 50 kW but not exceeding 1 MW. | Small RES Installation - requires registration in the small producers of RES register 📄. There’s no room for “later” here – better not leave it till the last minute! ⏳ |
Large-Scale Biogas Plant | Biogas plant with a capacity exceeding 1 MW. | Requires a license for generating RES electricity ⚡. It’s a bit like getting a driver’s license, but for biogas! 🚗💨 |
Agricultural Biogas Plant | Agricultural biogas plant producing up to 200,000 m³ of agricultural biogas per year. | Notification to the distribution system operator 📑 – no additional permits required. Simple as one plus one! ➕➖ |
Larger Agricultural Biogas Plant | Agricultural biogas plant with an annual output exceeding 200,000 m³ of biogas. | Registration in the agricultural biogas producers register maintained by KOWR 📝 is required. Yes, it’s a bit of bureaucracy, but don’t worry – everyone’s been through it! 🙌 |
Each type of biogas plant has its specific legal requirements, so it’s essential to prepare well before starting your business. If you have doubts about choosing the right type of permit, consulting with a lawyer specializing in RES is a good idea 🌍. Because who said that paperwork has to be boring? 😉

Permit for the Production of Electricity from Renewable Energy Sources ⚡
Obtaining a permit for the production of electricity from renewable energy sources (RES) is the final step before you start selling electricity from your biogas plant 💡. Below, we present key information so you know what to expect on this journey.
Why do you need a permit? 🎯
A permit is nothing more than a green light from the government to operate in an important sector—energy. With it, you can legally engage in an area that has significant importance for the public interest. The decision defines the conditions and duration of your activity, so it's somewhat like a "passport" to the energy world.
When do you need to obtain the decision? ⏳
When the biogas plant is ready for operation and connected to the power grid, it's time to obtain the permit. Yes, this is the last decision in the investment process—if you’ve made it this far, you’re one step away from success! 🏁
What do you need to attach to the application? 📄
The application for the permit is a true checklist! Here are the key elements that should be included:
👤 Applicant’s details (that is, yours) and address
💬 Request for the issuance of a permit for the production of energy from RES
🏢 Current excerpt from the National Court Register (KRS)
🤝 List of entities that have an impact on your company (with information about their lack of criminal record)
📜 Statement that no bankruptcy application has been filed against you
🛠 Statement that your employees have the required qualifications to operate the equipment
🏢 Documents confirming the rights to the facilities and installations
📊 Financial statements and other documents confirming your financial capabilities
📋 Diagram of power output and description of the technical parameters of the equipment
In total, it's quite a bit, but don't worry—this is standard procedure! 📑
How long will it take? ⏳
In theory, the decision should be issued within a month... but in practice, it may take several months. So, arm yourself with patience—the bureaucracy can be as unpredictable as the weather 🌦.
Who issues the permit? 🏢
The permit for the production of electricity from RES is issued by the President of the Energy Regulatory Office (URE). You submit the application to the URE branch appropriate for the location of your biogas plant.
How much does it cost? 💸
The fee for issuing the permit is 616 PLN—not too bad, right? 😉 Additionally, if you’re acting through a proxy, you need to add 17 PLN for the power of attorney.
What if something goes wrong? ❓
If for some reason you disagree with the decision, you can appeal. You have 2 weeks to do this, and you must direct your appeal to the District Court in Warsaw. The cost? 1000 PLN.
Can you submit the application electronically? 💻
Yes, you can also submit the application via ePUAP—because who said everything has to be on paper?

Register of Small Installation Energy Producers from RES ⚡🌱
If you have a biogas plant with an electrical capacity between 50 kW and 1 MW, instead of obtaining a permit, you need to register in the Register of Small Installation Energy Producers from RES. This makes life easier, as the process is quicker and simpler!
Why register? 🤔
The purpose of registration is to simplify and expedite the authorization process for conducting business in the energy sector. This allows you to operate legally in the RES industry without going through the full permitting process.
When do you need to obtain registration? 🏗
Registration is required after the construction is completed, the plant has been inspected, and it is connected to the grid. This is your last step before starting operations! 🏁
What do you need to include with your application? 📑
You can find the application on the URE website, and here’s what you need to attach:
📜 Statement of no tax, fee, or social insurance arrears
✔️ Statement confirming the accuracy of the information in the application (under penalty of criminal responsibility!)
💵 Proof of payment of the registration fee
📝 Power of attorney if the application is submitted by a proxy, along with proof of payment of the power of attorney fee
How does the process work? 🚦
The authority (URE) checks whether everything is in order. If no errors are found, they will register you and issue a certificate. Voilà, you are now an official energy producer from a small installation of RES! 🌍💡
How long does it take? ⏳
The President of URE has 21 days to complete the registration from the moment the application is received. And if they are late? You can start your business 28 days after submitting the application—regardless of the registration.
Important: Reporting 📊
After obtaining registration, you will need to submit regular reports—most often to the President of URE.
Fees 💸
Registration fee: 616 PLN
Power of attorney fee: 17 PLN
What if you disagree with the decision? ❓
If the decision is not in your favor, you have 2 weeks to appeal to the Court for Competition and Consumer Protection in Warsaw. The cost of the appeal is 1000 PLN.
Option to submit the application electronically 💻
Yes, you can submit the application via the ePUAP platform!
